1. Acceptance of Terms
By registering for, accessing, or using the Money Wize Owl platform ("Platform"), operated by Only Labs (Pty) Ltd ("Only Labs", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms") in their entirety. If you do not agree, you must immediately cease use of the Platform. These Terms constitute a legally binding agreement between you and Only Labs.
2. Nature of the Service — Lead Marketplace Only
Money Wize Owl is a lead generation marketplace. We connect businesses ("Buyers") with consumers ("Leads") who have voluntarily expressed interest in debt review, debt review removal, or insurance products. We are not a financial service provider, broker, advisor, or intermediary as defined under the Financial Advisory and Intermediary Services Act (FAIS) or any other South African financial legislation. Nothing on this Platform constitutes financial advice.
3. Absolutely No Refunds
All lead sales are final and non-refundable without exception. Each lead is generated through real-time paid media spend and is unique to the moment of purchase. Once a lead has been delivered to your dashboard — whether or not you have viewed, contacted, or successfully converted it — no refund, credit, exchange, or dispute will be entertained. By completing a purchase, you expressly acknowledge and accept this policy.
Specifically, we do not issue refunds for: wrong number, no answer, consumer changed their mind, duplicate contact, inability to convert, leads outside your preferred area, or any other outcome post-delivery. Consumer quality is maintained through our acquisition process, but human behaviour after the point of inquiry is outside our control.
4. No Guarantee of Conversions or Outcomes
We make no representation, warranty, or guarantee — express or implied — regarding conversion rates, sales outcomes, revenue generation, or return on investment. A lead represents a consumer who voluntarily requested assistance at a specific point in time. Consumer intent, circumstances, and availability may change. Only Labs is not liable for any failure to convert a lead into a client, sale, or policy.
Past performance of lead categories on this Platform does not guarantee future results. Conversion rates vary by industry, region, sales process, and individual Buyer capability.
5. Acceptable Use of Lead Data
Lead data (including consumer contact information) is licensed to you for a single, specific commercial purpose: to contact the consumer regarding the exact service category they requested (e.g. Debt Review, Debt Review Removal, Insurance). You may not:
- Resell, redistribute, sublicense, or share lead data with third parties
- Use lead data for any purpose other than the category purchased
- Contact leads through automated bulk messaging, spam, or robocalls
- Use lead data in a manner that violates the Protection of Personal Information Act (POPIA), the Consumer Protection Act (CPA), or any applicable South African law
- Store lead data beyond what is reasonably necessary for the transaction
Violation of these restrictions entitles Only Labs to immediately terminate your account without refund and pursue civil or criminal remedies as appropriate.
6. POPIA Compliance Obligation
As a Buyer, you become an independent responsible party under POPIA upon receiving lead data. You are solely responsible for your own POPIA compliance, including obtaining or maintaining any required lawful basis for further processing. Only Labs is not liable for any POPIA breach caused by a Buyer's use of lead data after delivery.
7. Payments and Billing
All payments are processed via Paystack, a PCI-compliant payment provider. By purchasing leads, you authorise the applicable charge. Only Labs does not store raw card details. Disputed or charged-back transactions will result in immediate account suspension pending investigation.
8. Account Suspension and Termination
Only Labs reserves the right, at its sole discretion and without prior notice, to suspend or permanently terminate any account that: abuses the Platform, engages in fraudulent activity, violates these Terms, harasses or deceives consumers, fails payment obligations, or is otherwise deemed harmful to the Platform or its users. No refunds are issued upon termination for cause.
9. Limitation of Liability
To the maximum extent permitted by South African law, Only Labs, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) your use of or inability to use the Platform; (b) any lead purchase; (c) any failure to convert a lead; (d) unauthorised access to or alteration of your account; or (e) any other matter relating to the Platform. Our total aggregate liability to you shall not exceed the amount paid for the specific lead purchase that gave rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Only Labs and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, your misuse of lead data, or your violation of any applicable law.
11. Changes to Terms
Only Labs may update these Terms at any time. Continued use of the Platform following notification of changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notice.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
